Durable Power of AttorneyAlong with your Advance Health Care Directive, this document protects your estate while you are alive. In this document, you appoint an Attorney-in-Fact to execute financial transactions and manage your financial affairs if you become incapacitated. This is important because without such authority, your financial affairs will be in limbo and your asset structure may be seriously eroded during your incapacity. Your Attorney-in-Fact need not be particularly financially savvy, but should be someone who is familiar with your finances and can execute the types of transactions that you would engage in were you not incapacitated.
